Abuse case hearing posted on March 29

MYSORE: The University sexual harassment inquiry committee on Friday posted the hearing to March 29 after the accused Shivabasavaiah deposed before it.

Though the zoology professor, who is now suspended, sought one month’s time, the probe panel turned it down and allowed him 17 days to file a written reply. During the next hearing, research scholar M Saritha, who is now discharged from the private hospital, is likely to be summoned for examination and cross-examination.

In the absence of panel head K Yashodara, member of the committee Swaranamala presided over the hearing. Shivabasavaiah deposed before the panel for an hour. This follows a notice issued to him on Tuesday. “We have posted the matter to March 29,” Swaranamala said. “He asked for one month’s time but since we have been asked to expedite the probe, we allotted him about two weeks,” she stated.

One of the panel members told TOI that Shivabasavaiah said he was in tension and hence needed at least one month’s time. The panel told him he would be given one week’s time. But Shivabasavaiah said he needed counselling and medical care following which he was given additional time, the member, who didn’t want to be named, explained.

The committee had also issued a notice to research scholar Saritha to appear before it on Friday. However, Saritha’s husband sought more time, which was allowed. According to him, the notice reached them at around 3pm on Thursday, and since Saritha is still recovering, they could not make it on Friday.

Meanwhile, the Mysore University Dalit Employees Association has stated in a release that a fair probe should be conducted into the incident. It termed the suspension of Shivabasavaiah when probe is still on as a denial of natural justice.

ಮಾನ್ಯರೆ ಒಂದಂತೂ ನಿಜ, ಈ ಪ್ರಪಂಚದಲ್ಲಿ ದಲಿತನಾಗಿ ಹುಟ್ಟಬಾರದು. ಅದೇ ಹುಟ್ಟಿ ಸಣ್ಣ ಪುಟ್ಟ ತಪ್ಪುಮಾಡಿ ದರಂತೂ ಅಥವಾ ಆರೋಪ ಬಂದರಂತೂ ಅವನ ಕಥೆ ಮುಗಿದಂತೆಯೆ. ಮೈಸೂರು ವಿ.ವಿ. ಪ್ರಾಧ್ಯಾಪಕ ಶಿವಬಸವಯ್ಯನವರ ವಿಷಯದಲ್ಲಿ ಆಗುತ್ತಿರುವುದು ಇದೇ. ಅಂದಹಾಗೆ ಇದು ಶಿವಬಸವಯ್ಯನವರೊಬ್ಬರ ಕಥೆಯಲ್ಲ. ದಲಿತರ ವಿಷಯದಲ್ಲಿ ಹಿಂದೆ ಇಂತಹದ್ದು ಹಲವಾರು ನಡೆದಿವೆ. ಉದಾಹರಣೆಗೆ ಹೇಳುವುದಾದರೆ ಬೂಸಾ ಪ್ರಕರಣಕ್ಕೆ ಸಂಬಂಧ ಪಟ್ಟಂತೆ ದಿ.ಬಿ. ಬಸವಲಿಂಗಪ್ಪನವರ ರಾಜೀನಾಮೆ ಪಡೆದದ್ದು, ಕಾಪಿ ಹಗರಣದಲ್ಲಿ ಮಾಜಿ ಸಚಿವ ಬಿ.ಸೋಮಶೇಖರ್‌ರವರ ರಾಜೀನಾಮೆ ಪಡೆದದ್ದು, ಇತ್ತೀಚಿನ 2ಜಿ ಸ್ಪೆಕ್ಟ್ರಂ ಪ್ರಕರಣ. 

ಅಬ್ಬಾ ಹೇಳುತ್ತಾ ಹೋದರೆ ಅದೆಷ್ಟು ದಲಿತ ಮಂತ್ರಿಗಳು, ಆಧಿಕಾರಿಗಳು, ಪ್ರಾಧ್ಯಾಪಕರು, ಶಿಕ್ಷಕರು, ನೌಕರರು ಇಂತಹ ವ್ಯವಸ್ಥಿತ ಕುತಂತ್ರಿ ಅಸ್ಪಶತಾಚರಣೆಗೆ ಒಳಪಟ್ಟಿದ್ದಾರೆಯೋ? ಒಂದಂತು ನಿಜ . ಇವರೆಲ್ಲರ ವಿರುದ್ಧ ತಕ್ಷಣ ಕ್ರಮ ಕೈಗೊಳ್ಳಲಾಗಿದೆ. ಬಂಧಿಸಿ ಜೈಲಿಗೆ ಅಟ್ಟಲಾಗಿದೆ! ಆದರೆ? ಮಾಜಿ ಪ್ರದಾನಿ ದಿ. ರಾಜೀವ್ ಗಾಂಧಿ ಮತ್ತವರ ಕುಟುಂಬ ಬೋಫೋರ್ಸ್‌ನಂತಹ ಬೃಹತ್ ಹಗರಣದಲ್ಲಿ ಪಾಲ್ಗೊಂಡರೂ ಅವರಿಗೆ ಶಿಕ್ಷೆಯಾ ಗಲೇ ಇಲ್ಲ! ಶಿಕ್ಷೆ ಇರಲಿ ಪ್ರಕರಣವನ್ನೇ ಮುಚ್ಚಿಹಾಕಲಾ ಯಿತು! ಮಾಜಿ ಉಪ ಪ್ರಧಾನಿ ಲಾಲ್‌ಕೃಷ್ಣಅಡ್ವಾಣಿ ಬಾಬ್ರಿ ಮಸೀದಿ ಧ್ವಂಸ ಪ್ರಕರಣದಲ್ಲಿ ಆರೋಪಿಯಾ ದರೂ ಅವರು ಆಧಿಕಾರದ ಮೇಲೆ ಅಧಿಕಾರ ಪಡೆ ಯುತ್ತಾ ಮನ್ನುಗ್ಗಿದರು. ಅದೇ ದಲಿತ ವರ್ಗಕ್ಕೆ ಸೇರಿದ ಬಂಗಾರು ಲಕ್ಷ್ಮಣ್? ಲಂಚ ಪ್ರಕರಣದಲ್ಲಿ ನೇಪಥ್ಯಕ್ಕೆ ಸರಿದರು!

ಒಂದು ದಾಖಲೆಯ ಪ್ರಕಾರ ಲೋಕಾಯುಕ್ತರ ಬಲೆಗೆ ಬಹುತೇಕ ಬೀಳುವವರು ಅಥವಾ ಬೀಳಿಸಲ್ಪಡುವವರು ದಲಿತ ನೌಕರರು! ಹಾಗಂತ ಸ್ವತಃ ವಿಧಾನ ಪರಿಷತ್ತಿನ ವಿರೋಧ ಪಕ್ಷದ ನಾಯಕಿ ಮೋಟಮ್ಮನವರೇ ಹೇಳಿ ದ್ದಾರೆ. ಹಾಗಿದ್ದರೆ ದಲಿತರು ಮಾತ್ರ ಭ್ರಷ್ಟರೇ? ದಲಿತರು ಮಾತ್ರ ವಿಷಯ ಲಂಪಟರೇ? ದಲಿತರು ಮಾಡಿದ್ದು ಮಾತ್ರ ಅಪರಾಧವೇ? ಇತ್ತೀಚಿನ ಬೆಳವಣಿ ಗೆಗಳನ್ನು ನೋಡಿದರೆ ಹಾಗೆಯೇ ಅನಿಸುತ್ತಿದೆ.

ಯಾಕೆಂದರೆ 1.7 ಲಕ್ಷ ಕೋಟಿಯಂತಹ ಬೃಹತ್ ಹಗರಣದಲ್ಲಿ ಯಕಶ್ಚಿತ್ ಒಬ್ಬ ಮಂತ್ರಿ ದಲಿತ ವರ್ಗಕ್ಕೆ ಸೇರಿದೆ. ಎ.ರಾಜ ಬಲಿಯಾಗುತ್ತಾರೆ. ಆದರೆ ಅರುಣ್ ಶೌರಿ, ಧಯಾನಿಧಿ ಮಾರನ್, ನೀರಾ ರಾಡಿಯಾ, ಅನಂತ್ ಕುಮಾರ್ ಇವರೆಲ್ಲ? ರಾಜಾರೋಷವಾಗಿ ಓಡಾಡುತ್ತಾರೆ! ರೇಣುಕಾಚಾರ್ಯರಂತಹವರು ಲಜ್ಜೆಗೆಟ್ಟು ಬಹಿರಂಗವಾಗಿ ಮುತ್ತುಕೊಡುವಂತಹ ಹಗರಣದಲ್ಲಿ ಸಿಕ್ಕಿಬಿದ್ದರೂ ಮಂತ್ರಿಗಳಾಗುತ್ತಾರೆ! ವಾಸ್ತವ ಹೀಗಿರಬೇಕಾ ದರೆ ಶಿವಬಸವಯ್ಯನಂತಹವರು ಮಾಡಿದ ತಪ್ಪಾದರೂ ಏನು? ದಲಿತರಾಗಿ ಹುಟ್ಟಿದ್ದು! ಅಕಸ್ಮಾತ್ ಇವರೇನಾ ದರೂ ಮೇಲ್ವರ್ಗದಲ್ಲಿ ಹುಟ್ಟಿದ್ದರೆ ಇಷ್ಟೊತ್ತಿಗಾಗಲೇ ಅವರನ್ನು ರಕ್ಷಿಸುವ ಕಾರ್ಯ ಭರದಿಂದ ನಡೆದಿರುತಿತ್ತು! ಆದರೆ ಈಗ? ದಲಿತ ವರ್ಗಕ್ಕೆ ಸೇರಿದ ಶಿವಬಸವಯ್ಯ ನವರನ್ನು ಹಿಂದು ಮುಂದು ನೋಡದೆ ತಕ್ಷಣ ಅಮಾನತು ಮಾಡಲಾಗಿದೆ. ಜೈಲಿಗೆ ಅಟ್ಟಲಾಗಿದೆ! ದಲಿತ ನೌಕರರ ವಿರುದ್ಧ ವ್ಯವಸ್ಥಿತ ಮತ್ತು ಸುಶಿಕ್ಷಿತ ಅಸ್ಪಶತಾಚರಣೆ ಎಂದರೆ ಇದೇ ಅಲ್ಲವೇ?

Discrimination against Dalits prevalent: study

Caste discrimination practised against Dalits does not spare even panchayat presidents, reveals a study conducted in select districts of Tamil Nadu.

The study conducted by Evidence, a Madurai-based organisation, in 213 panchayats across 12 districts in the State has come up with its findings on myriad forms of discrimination experienced by Dalits under various categories.

The survey was held in Madurai, Dindigul, Virudhunagar, Sivagangai, Thanjavur, Nagapattinam, Salem, Namakkal, Cuddalore, Villupuram, Coimbatore and Tirupur.

Forty-five panchayat presidents from nine districts have given testimonies of discrimination, the survey reports. The discrimination takes the form of demand for appointment of Caste Hindu writer, refusal to cooperate with the panchayat president, obstructionist tactics by the Caste Hindu Ward members and panchayat vice-president to stall conduct of affairs and harassment of women panchayat presidents.

The 198-page report reveals an exhaustive account of various forms of discrimination and how they assume universality under certain categories. These include discrimination in temples, atrocities against Dalit women and discrimination in processions, burial of the dead and in offering services such as hair dressing and laundry to the Dalits.

With a few exceptions, almost all villages witness such discrimination.

RESTRICTIONS

Discrimination in temples varies from restrictions on entry to bar on touching the temple car rope and participation in festivities or allowing processions to go through Dalit colonies.

According to the report, 104 villages out of the total villages surveyed recorded the practice of two-tumbler system, revealing 49 per cent prevalence. Among them, 14 out of 22 villages in Coimbatore, 14 out of 24 villages in Dindigul, 13 out of 21 in Salem, 13 out of 17 villages in Virudhunagar, 11 out of 17 villages in Thanjavur and seven out of 13 villages in Madurai, recorded the practice.

In Nagapattinam, the study carried out in 16 villages in Vedaranyam reveals the prevalence of two tumbler system in Kodiakkarai, Vedananagar, Ayyakaranpulamirandamsethi, and Siriyankadu.

Of the categories, discrimination was negligible only in Government Hospitals and PHCs.

Rape-accused BSP MLA suspended

Uttar Pradesh Chief Minister Mayawati on Sunday suspended a legislator of her Bahujan Samaj Party (BSP) accused of raping a minor girl. In an order, the chief minister said BSP legislator Pushottam Narain Dwivedi has been suspended from the party pending an inquiry by the Crime Investigation

Department. If found guilty, Dwivedi will be expelled from the party and sent to jail.

 

“No one, howsoever important, will be spared,” the chief minister said in a stern message.

On Saturday, the chief minister ordered a police inquiry into the allegations of gangrape and illegal confinement of a minor girl by Dwivedi and his supporters in the state’s Banda district.

The girl, belonging to the Dalit community, had accused Dwivedi and his henchmen of not only subjecting her to gangrape but also using his influence to implicate her in a theft case.

Dwivedi accused her of stealing his licenced revolver and Rs.5,000 from his house, for which she was currently lodged in jail in Banda, 180 km from Lucknow.

Mayawati got into action only after the issue was raised by both state Congress chief Rita Bahuguna Joshi and Samajwadi Party president Mulayam Singh Yadav, who charged her with shielding criminals in her party.

AP: Upper castes deny water to dalits in village

NELLORE: Tension prevailed in Vaddipalem hamlet of Kothavangallu village panachayat in Kodavaluru mandal when the upper caste people of the village prevented dalits from the Dalitwada from using water of the village well.

As the news spread like wildfire, several dalit organisations rushed to the village resulting in exchange of arguments between the upper caste people and dalit leaders. District collector K Ramgopal directed the Kodavaluru MRO to get the pipeline fixed and restore water supply from the well to the Dalitwada and submit a report on the incident immediately.

Vaddipalem, 30 km from here, has two wells, one used by the upper castes and the other by dalits. The water in the well meant for dalits got contaminated a few months ago. Following a request by the dalits, the collector sanctioned Rs1 lakh for laying a pipeline from the other well in the village to supply drinking water to the Dalitwada.

According to Kodavalur tahsildar N Syamalamma, the two groups had agreed to the arrangement and things went smoothly.

However, four days ago, an upper caste person had allegedly de-linked the pipeline cutting of water to Dalits.When the dalits went to the well to fetch water, they were chased away by the upper caste people. The dalits were forced to use the contaminated water for the last four days.

As the news spread, several dalit leaders from other places rushed to the village in support of the local dalits.

MRPS district president J Ramanaiah condemned the ill-treatment of dalits and said even after six decades of independence, caste discrimination was still prevalent and Vaddipallem incident stood  testimony to it. Bahujan Samaj Party Kovur incharge B Mastanaiah said it was unfortunate that discrimination against dalits was still continuing.

Dalit seeks non-Brahmin judge for fair trial in High Court

AHMEDABAD: A Gujarat high court judge got offended and dismissed a case filed by a dalit when his lawyer requested the judge not to hear the case and shift it to some other bench because the judge himself was a Brahmin and that he would not be able to do justice in the case.

The petitioner, Ajit Makwana, had filed a complaint against the Junagadh district judge who, he said, was favouring only Brahmins for posts of Class III and Class IV staff.

Makwana’s lawyer, A M Chauhan, told the court that nearly 60% of selected candidates were Brahmins. The petitioner accused the judicial officer of promoting Brahmins and in doing so, he conducted interviews twice and deprived him of the opportunity.

However, Chauhan’s accusations on behalf of his client, Makwana, stunned Justice R R Tripathi. The advocate submitted: “The surname suggests that Your Lordship also belongs to the same community and, therefore, I want that this court may not hear this matter.”

Justice Tripathi could not take it anymore and mentioned in the order that he had come across such an argument for the first time from any advocate after he assumed office as judge of the high court.

The judge thought that this was a “fit case” for issuing “notice for contempt” against the advocate, and if he was saying so on instruction from his client, then against him also.

However, he restrained himself.

Justice Tripathi dismissed the case with the observation that the statement was made only with a view to either bring pressure on the court and obtain a favourable order, or get the case out of this court. “The court deems it proper to dismiss the matter so as to discourage such a practice.”

Dalit proves point on horseback- Rajasthan University

JAIPUR: It was an unusual day at Rajasthan University on Thursday when a dalit student, Raj Tepan, came on horseback with his supporters and musical band following him up to the vice chancellor’s office. Reason: Dalit students wanted to prove that the derogatory remarks made by their ‘guru’ P D Sharma, who said dalits are not entitled to ride horses, were absurd.

The professor has since apologized for the remark, but not before the Dalit students raised a huge shindig. Demanding Sharma’s arrest, they served gave a memorandum to vice-chancellor A D Sawant to withdraw facilities given to him, including pension and staff residential quarters.

Tepan claimed their aim was to teach a lesson to their professor who still believed that dalit students do not deserve respect in society.

“Considering the remark Sharma made at a seminar, that dalits shouldn’t be allowed to ride a horse, I decided to prove him wrong by coming to university campus on horseback along with a band,” he said.

Student of MA first year, Tepan, who claims to have been present at the seminar, said it was shocking that faculty members of reputed institutions had such mindset.

While meeting the vice-chancellor, students demanded that Sharma should apologize in public as he made remarks in seminar due to which dalit sentiments were hurt.

A similar memorandum was submitted to circle officer (Gandhi Nagar) Anil Rao in which they demanded Sharma’s arrest within three days.

Student leader Sunil Khatik alleged the police was not taking action against the guilty teacher and said a case was filed against Sharma after two days only when students’ group met a minister and were assured about action in the case.

“If he is not arrested within three days, a statewide agitation will be launched,” he warned. With Sharma’s apology, the students have called off the agitation.
